Model Train Media User Agreement.

Welcome to Model Train Media, a social media platform dedicated to model train enthusiasts. By creating an account and using our platform, you agree to the terms outlined in this agreement. If you do not agree, please refrain from using our services.

Model Train Media is operated by a single individual based in the Netherlands. While I strive to provide a safe and enjoyable platform, please understand that I cannot guarantee perfection in all areas. This agreement is designed to clarify your rights and responsibilities while limiting my liability as the sole operator of this platform.

1. Acceptance of Terms

1.1. By creating an account, you confirm that you are at least 16 years old and legally capable of entering into this agreement.

1.2. I reserve the right to update or modify these terms at any time. Significant changes will be communicated through the platform at least 30 days before they take effect.

1.3. Continued use of the platform after changes constitutes acceptance of the new terms. If you do not agree with the changes, you may delete your account.

2. User Conduct and Content

2.1. You agree to:

Post only appropriate and relevant content related to model trains.
Refrain from posting offensive, hateful, obscene, or illegal content.
Respect other users and refrain from harassment, bullying, or spam.
Not use the platform for commercial advertising or promotional spam without explicit permission.

2.2. Prohibited activities include:

Sharing personal information of others without their consent.
Impersonating other users or entities.
Attempting to gain unauthorized access to accounts or systems.
Using the platform to distribute malware or engage in phishing activities.

2.3. I reserve the right to remove any content that violates these rules at my sole discretion.

Users may share a maximum of one (1) external link per day. This is to ensure that the activity feed remains relevant, valuable, and enjoyable for all members of the community!

3. Account Suspension and Termination

3.1. I reserve the right to suspend or permanently ban any user at any time, with or without notice, for violating this agreement or engaging in behavior deemed harmful to the community.

3.2. If your account is terminated:

You will lose access to your content and data on the platform.
I will retain your data for up to 30 days, during which you may request a copy by contacting me at .
After 30 days, your data will be permanently deleted from active systems.

3.3. You may delete your account at any time through your account settings.

3.4. We have zero tolerance for objectionable content and abusive behavior. Content or users violating these rules will be removed immediately.

3.5 Users have the ability to block other users. When a user is blocked, their content will no longer be visible to the blocking user.

3.6 Users can report content or behavior directly within the app using built-in reporting tools.

3.7 All reports are reviewed within 24 hours. We take appropriate action, including removing content and suspending or banning users where necessary.

4. Privacy and Data Usage

4.1. I collect basic user information (e.g., username, email address, IP address) for security and functionality purposes.

4.2. By using this platform, you agree that your posted content may be visible to other users and the public.

4.3. I do not sell user data to third parties but may use anonymized data for improving the platform.

4.4. As required by EU law (GDPR), you have the following rights regarding your personal data:

5. Intellectual Property

5.2. This license ends when you delete your content or account unless it has been shared with others who have not deleted it.

5.3. You are responsible for ensuring that you have the necessary rights to any content you upload (e.g., images, text).

6. Limitation of Liability

6.1. Modeltrainscenes is provided “as is” without warranties of any kind, express or implied.

6.2. As a single operator:

I cannot guarantee uninterrupted service or immediate responses to issues.
I am not responsible for user-generated content (e.g., copyright violations or offensive material).
I am not liable for damages resulting from downtime, technical failures, or unauthorized access to accounts.

6.3. To the fullest extent permitted by law:

My total liability for any claims arising from this agreement will not exceed €50 or the amount you paid (if applicable) in the past 12 months.
I am not liable for indirect, incidental, punitive, or consequential damages.

7. Dispute Resolution

7.1. This agreement is governed by Dutch law.

7.2. Any disputes arising from this agreement will first be attempted to be resolved through good-faith communication via email ([email protected]).

7.3 If no resolution is reached within 30 days, disputes will be submitted exclusively to the competent court in [Your City], Netherlands.

8. Changes to This Agreement

8.1 I reserve the right to modify this agreement at any time and will provide notice of significant changes at least 30 days before they take effect.

8.2 If you do not agree with the updated terms, you may terminate your account before they become effective.

10. Child Safety

This app is not intended for children under 13 and may include user-generated content and user interactions. Users can report inappropriate content or behavior, and we may moderate or remove content and accounts that violate child safety standards.

Businesses on Model Train Media

We value the contribution of businesses within our community and want to set clear guidelines. This way, both hobbyists and businesses feel welcome, and the community remains a positive place for everyone.

1. Access & verification

Every business may create their own group, as long as they follow these rules.
Larger businesses will be asked to provide proof of authenticity to prevent fake accounts.
Each business may create a maximum of three groups (for example, for different product categories).

2. Group settings

Business groups must always be set to private. This ensures that users consciously choose to follow commercial updates.
Business posts must stay within these private groups and should not clutter the main community feed.

3. Transparency

Within their own private group, businesses may freely promote their products without an explicit “ad” label.
Whenever a business posts outside of their own group, the content must always be clearly marked as advertising (e.g., “advertisement” or “promo”), in line with EU regulations.

4. Costs & the future

The use of business groups will remain free until January 1st, 2027.
After this date, a fee may be introduced to help keep the platform running for both hobbyists and businesses.

5. Partners & sponsors

We are committed to giving our official partners and sponsors additional exposure.
This ensures that becoming an advertiser or sponsor on Model Train Media is always worthwhile.

6. Misuse & sanctions

Misleading advertisements, spam, or repeated complaints from the community will be taken seriously.
We will always start with a conversation to resolve issues.
If there is no improvement, we reserve the right to remove business accounts or groups.
Users have the ability to block other users. When a user is blocked, their content will no longer be visible to the blocking user.

Why this matters
Our goal is to keep Model Train Media a place where the hobby comes first, while giving businesses the opportunity to share their products in a respectful way. Only by keeping this balance can the community continue to grow and thrive.
